Terms and Conditions
Deposit
A $100 deposit is required to make the booking. No booking is confirmed until the $100 deposit has been cleared into Custom Cakes by Brooke’s account. The deposit is refundable up to 1 month before the event, less expenses already purchased for the order. By paying this deposit you agree to be bound by the following terms and conditions.
Payment
Your deposit of the $100 will be taken off your final balance. Full payment of your order is required 7 days before your event. Unless the arrangement is made to be paid in cash on pick up – this applies to pick up’s only. Failure to pay the balance of your order may result in your order being cancelled. Payment can be made by direct deposit or cash. All funds must be cleared into Custom Cakes by Brooke’s account before a payment is considered to be received.
Cancellations
Cancellations must be made in writing at least 30 days prior to your event date. Cancellation of your order less than 30 days before your event date will result in the loss of your deposit.
Date changes
If you require a change to the date of your order, requests to change the date must be made in writing and are subject to Custom Cakes by Brooke’s availability. Please contact us to discuss options and availability.
Design agreement
Every effort will be made by Custom Cakes by Brooke to fulfil your expectations as to the design of the cake. When replicating a design from a photo provided by the client it is important to be aware that no two cakes will ever be identical, particularly when the design is a different cake decorator’s. There may be times during the construction and decoration of your cake where Custom Cakes by Brooke is required to make a decision which may alter the design of your cake to accommodate decorations or the proportion or structure of your cake, particularly when using another cake decorator’s design. There may also be factors, including but not limited to weather or supply issues, outside of Custom Cakes by Brooke’s control which may affect your design. Any extra embellishments provided by you (e.g. cake topper, faux/silk flowers, ribbons etc.) must be either delivered to Custom Cakes by Brooke prior to your event and clearly labelled with your name and the date of your event or left with your reception venue to be placed on the cake table ready for installation. These extra embellishments must be suitable for your cake as per the agreed design (e.g. correct length and thickness of ribbon etc.). Any embellishments not meeting health and safety regulations are unable to be used. If items, such as cake toppers, are provided in a box, the box will be left at the venue with a member of staff. No responsibility is assumed by Custom Cakes by Brooke for lost or misplaced boxes or decorations.
Changes to order
Reasonable changes (e.g. flavour, shapes or decorations) to your order may be made up to 21 days before your event. Any changes to your original order are subject to our approval and a quote review. All requests to change your order must be made in writing and are subject to agreement by Custom Cakes by Brooke. An updated invoice will be issued once changes and any quote reviews are agreed to by both parties.
No changes to orders can be made within 7 days of the event.
Delivery, set up and Pick ups
Delivery and set up of your cake is available and preferred for weddings. However, all deliveries incur a fee dependent on the location. If you require delivery, please ensure you give correct address details and contact numbers for any venues or people to contact on the day of delivery.
If you’d prefer to pick up your cake, no responsibility will be assumed by Custom Cakes by Brooke if your cake is damaged after pick up. We take pictures of all our cakes before they’re collected. If you do damage your cake during delivery, please contact us so we can assess the damage and see if it’s able to be repaired. Repairs will be charged at an hourly rate and costs will include any extra ingredients needed for the repair. Please note that repairs may not always be available as we often have other deliveries to attend to
Supplying your own fresh flowers
You are welcome to supply your own fresh flowers to place on your cake however certain conditions must be met before I will agree to place them on the cake.
• Flowers must be individually wired and taped, pre-clustered or set in an invisible oasis block.
• Flowers must be delivered to the venue, or to Custom Cakes by Brooke, at an agreed time to ensure enough time for placement.
• Any inferior quality flowers (e.g. bruised or damaged) are your responsibility.
• You are responsible for ensuring that the correct flowers, in suitable quantities, are ordered for placement on your cake.
Special dietary and allergy requirements
Custom Cakes by Brooke uses a kitchen and equipment that has been in contact with nuts, gluten, dairy, soy, eggs, and other allergens. No guarantees are provided that a cake is allergen-free. It is your responsibility to ensure any of your guests with allergies are informed of this. Custom Cakes by Brooke accepts no responsibility for any symptoms or reactions that you, or your guests, may suffer as a result of eating our cakes. As such, we cater to intolerance and lifestyle choice only. Not to severe coeliac sufferers.
Naked Cakes
Due to the cake being exposed to the air for an extended period of time there is a possibility of the cake drying out. Custom Cakes by Brooke will do all in our power to provide a fresh moist mud cake on delivery but cannot guarantee its freshness once it is finally cut.
Image use
Custom Cakes by Brooke reserves the right to photograph our cakes and we reserve the right to use these images for any display, promotion, or advertising without compensation to you.
Stand Hire
Cake stands, cupcake towers & risers must be returned within 1 week after the event date. Longer hire can be arranged if agreed with Custom Cakes by Brooke. Custom Cakes by Brooke reserves the right to charge additional costs if no prior arrangement has been made. Once the stand has been returned and inspected and is in a good condition your safety bond will be returned to you in the same way Custom Cakes by Brooke received it, i.e. cash or bank transfer
